Scholars of Aquinas’s doctrine of analogy have traditionally devoted their attention to the question of which kind of analogy, that of proportionality or that of attribution, is the most relevant for Aquinas. However, a closer study of some of Aquinas’s crucial texts reveals that there are prior and more fundamental problems. A relevant difficulty concerns the characteristics of the focus of an analogical predication. In book one of the Consolation of Philosophy, Boethius is portrayed as a man who suffers because he forgot philosophy. Scholars have underestimated the significance of this portrayal and considered it a literary device the goal of which is simply to introduce the discussion that follows. In this paper, I show that this view is mistaken since it overlooks that this portrayal of Boethius is the key for the understanding of the whole text. The philosophical therapy that constitutes the core (...) of the ?Consolation? can in fact be properly evaluated only if we recognize the condition it is designed to cure. Through the portrayal of Boethius's forgetfulness, the ?Consolation? illustrates that it is the very nature of philosophical knowledge that makes it susceptible to being forgotten. Philosophical knowledge can (i) turn into misology, when it appears unable to solve certain problems, and (ii) be overrun by strong emotions. The therapy offered in the ?Consolation? is designed to make Boethius aware of the ?fragility? of philosophical knowledge and show him how to ?strengthen? it. He is taught how to more fully embody philosophy's precepts and that philosophy's inability to solve certain problems reveals not its failures but its limits. (shrink)

The article reflects on the relationship between pedagogy and body moving from the sense of tact. Firstly, the question of the body-mind relationship in contemporary pedagogy is presented. Starting from the cartesian division of mind and body, we expose the main issues related to a possible overcoming of such dualism. In addition, we maintain that cartesian dualism significantly contributed to a dominance of mind over body in education. Then, we reconstruct the history of “pedagogical tact”: this concept changed from an (...) original somatic significance to a more interpersonal sense, putting the question of the body aside. In conclusion, we maintain that re-considering tact in its somatic significance can help build innovative pedagogical theories and practices aimed at a broader reconsideration of bodies in education. This book provides the first English study of five prominent Italian Renaissance utopias: Doni’s Wise and Crazy World, Patrizi’s The Happy City, and Zuccolo’s The Republic of Utopia, The Republic of Evandria, and The Happy City. The scholarship on Italian Renaissance utopias is still relatively underdeveloped; there is no English translation of these texts, and our understanding of the distinctive features of this utopian tradition is rather limited. This book therefore fills an important gap in the existing critical literature, providing (...) easier access to these utopian texts, and showing how the study of the utopias of Doni, Patrizi, and Zuccolo can shed crucial light on the scholarly debate about the essential traits of Renaissance utopias. Antonio Negri, one of the world's leading scholars on Baruch Spinoza (1632-1677) and his contemporary legacy, offers a straightforward explanation of the philosopher's elaborate arguments and a persuasive case for his ongoing relevance. Responding to a resurgent interest in Spinoza's thought and its potential application to contemporary global issues, Negri demonstrates the thinker's special value to politics, philosophy, and related disciplines. Negri's work is both a return to and an advancement of his initial affirmation of Spinozian thought in _The (...) Savage Anomaly_. He further defends his understanding of the philosopher as a proto-postmodernist, or a thinker who is just now, with the advent of the postmodern, becoming contemporary. Negri also connects Spinoza's theories to recent trends in political philosophy, particularly the reengagement with Carl Schmitt's "political theology," and the history of philosophy, including the argument that Spinoza belongs to a "radical enlightenment." By positioning Spinoza as a contemporary revolutionary intellectual, Negri addresses and effectively defeats twentieth-century critiques of the thinker waged by Jacques Derrida, Alain Badiou, and Giorgio Agamben. This paper provides a detailed analysis of how, according to Kant, the moral badness of some third parties’ actions can be established with certainty (by anyone, not only by the agent’s own conscience or by God). This account helps clarify why Kant affirms that some forms of wrongdoing (of which there are a “multitude of woeful examples”) can be demonstrated to be immoral, while excluding the possibility of proving the moral goodness of any action. Deferred prosecution agreements (DPAs) are legal means, alternative to trial, for the resolution of criminal business cases. Although DPAs are increasingly used in the US and are spreading to other jurisdictions, the ethics of DPAs has hardly been subjected to critical scrutiny. We use a multidisciplinary approach straddling the line between philosophy and law to examine the ethics of DPAs used to resolve cases of multinational enterprises’ (MNEs) foreign corruption. Deontologically, we argue that the normativity of DPAs raises critical concerns (...) related to the notion of justice as punishment, with serious cases of international corruption resolved with minimal retribution for offending MNEs. Taking a utilitarian ethical perspective, we also evaluate the effect of DPAs on MNEs’ tendency to self-regulate or re-offend. Our conclusion, supported by critical analysis of the juridical literature and case evidence on MNEs’ recidivism, is that DPAs do not foster ethical behavior. (shrink)

_Factory of Strategy_ is the last of Antonio Negri's major political works to be translated into English. Rigorous and accessible, it is both a systematic inquiry into the development of Lenin's thought and an encapsulation of a critical shift in Negri's theoretical trajectory. Lenin is the only prominent politician of the modern era to seriously question the "withering away" and "extinction" of the state, and like Marx, he recognized the link between capitalism and modern sovereignty and the need to (...) destroy capitalism and reconfigure the state. Negri refrains from portraying Lenin as a ferocious dictator enforcing the proletariat's reappropriation of wealth, nor does he depict him as a mere military tool of a vanguard opposed to the Ancien Régime. Negri instead champions Leninism's ability to adapt to different working-class configurations in Russia, China, Latin America, and elsewhere. He argues that Lenin developed a new political figuration in and beyond modernity and an effective organization capable of absorbing different historical conditions. He ultimately urges readers to recognize the universal application of Leninism today and its potential to institutionally--not anarchically--dismantle centralized power. (shrink)

The fiduciary nature of the patient-physician relationship requires clinicians to act in the best interest of their patients. Patients are vulnerable due to their health status and lack of medical knowledge, which makes them dependent on the clinicians’ expertise. Competent patients, however, may reject the recommendations of their physician, either refusing beneficial medical interventions or procedures based on their personal views that do not match the perceived medical indication. In some instances, the patients’ refusal may jeopardize their health or life (...) but also compromise the clinician’s moral responsibility to promote the patient’s best interests. In other words, health professionals have to deal with patients whose behavior and healthcare decisions seem counterproductive for their health, or even deteriorate it, because of lack of knowledge, bad habits or bias without being the patients’ free voluntary choice. The moral dilemma centers on issues surrounding the limits of the patient’s autonomy (rights) and the clinician’s role to promote the well-being of the patient (duties). In this paper we argue that (1) the use of manipulative strategies, albeit considered beneficent, defeats the purpose of patient education and therefore should be rejected; and (2) the appropriate strategy is to empower patients through patient education which enhances their autonomy and encourages them to become full healthcare partners as opposed to objects of clinical intervention or entities whose values or attitudes need to be shaped and changed through education. First, we provide a working definition of the concept of patient education and a brief historical overview of its origin. Second, we examine the nature of the patient-physician relationship in order to delineate its boundaries, essential for understanding the role of education in the clinical context. Third, we argue that patient education should promote self-rebiasing, enhance autonomy, and empower patients to determine their therapeutic goals. Instead of the currently prevailing competitive model, a more collaborative strategy is needed to address the concerns related to the unsustainability of today’s business. This article aims to explore collaborative approaches where enterprises seek to build long-term, mutually beneficial relationships with all stakeholders and want to produce sustainable values for their whole business ecosystem. Cases here analyzed demonstrate that alternative ways of doing business are possible. These enterprises share more democratic ownership structures, more balanced and broader governance systems, and a (...) more comprehensive view of organizational goals and performance – which goes beyond the narrow concept of financial bottom line and into a stronger and systematic care of the needs and requirements of the different stakeholder groups. Thanks to this evidence and different theoretical and empirical contributions, we suggest that the strength and sustainability of enterprises come from their ability to fit into the environmental, social, and cultural context in which they operate. By creating values for all stakeholders, enterprises can involve them and gain deep support based on their commitment. This may lead to superior performance from a multiple-bottom-line perspective. A statement of hyperarithmetic analysis is a sentence of second order arithmetic S such that for every Y⊆ω, the minimum ω-model containing Y of RCA0 + S is HYP, the ω-model consisting of the sets hyperarithmetic in Y. We provide an example of a mathematical theorem which is a statement of hyperarithmetic analysis. This statement, that we call INDEC, is due to Jullien [13]. To the author's knowledge, no other already published, purely mathematical statement has been found with this property (...) until now. We also prove that, over RCA0, INDEC is implied by [Formula: see text] and implies ACA0, but of course, neither ACA0, nor ACA 0+ imply it. We introduce five other statements of hyperarithmetic analysis and study the relations among them. Four of them are related to finitely-terminating games. The fifth one, related to iterations of the Turing jump, is strictly weaker than all the other statements that we study in this paper, as we prove using Steel's method of forcing with tagged trees. Pour cela, il retrace le processus de migration des savoirs indigénistes depuis leur contexte d'origine au Mexique jusqu'au Brésil, et les transformations qu'ils connaissent au cours de leur trajectoire jusqu'à aujourd'hui, en s'appuyant sur la notion de « traditions de savoirs » pour la gestion des populations qui se sont développées à partir de l'époque coloniale. This paper introduces a formal concept of ideology and ideological system. The formalization takes ideologies and ideological systems to be situated in agent societies. An ideological system is defined as a system of operations able to create, maintain, and extinguish the ideologies adopted by the social groups of agent societies. The concepts of group ideology, ideological contradiction, ideological dominance, and dominant ideology of an agent society, are defined. An ideology-based concept of social group is introduced. Relations between the proposed formal (...) concept of ideology and the classical concepts of ideology elaborated in social sciences are examined. A computational notation is presented, to support the realization of ideological systems in computationally implemented agent societies. The adequacy of the approach for the formal modeling and analysis of ideological issues is illustrated through three case studies. (shrink)

This essay is an attempt to establish the relevance of conceptual analysis and explication to the understanding of classical chinese philosophy. It is suggested that an employment of the methodology brings out problems of philosophical interest.

The paper, on the one hand, presents a reconstruction of the origin and development of the concepts of “anthropotechnics” and “homeotechnics” in Peter Sloterdijk’s thought, of the anthropological basis of his social philosophy, and of the question of subjectivity addressed in his book You Must Change Your Life (2009). On the other hand, it investigates with a critical aim the different forms of otherness that Sloterdijk theorizes in his philosophical works and the possible solipsistic implications of this concept.

El propósito de este trabajo consiste en exponer las tareas más apremiantes que, a juicio del autor, debe asumir la Filosofía del Derecho del presente y del inmediato futuro. Para ello, se analizan las dos tareas que se consideran de interés prioritario: la primera versa en torno a lo que entraña el desafío tecnológico propio de la sociedad digital que habitamos y que se concreta en la respuesta que desde la filosofía jurídica debe avanzarse respecto a la omnipresencia en todos (...) los ámbitos sociales, económicos, políticos, culturales y jurídicos de la Inteligencia Artificial (IA). Hace referencia la segunda al riesgo cultural que entraña la pretensión de determinados movimientos que se autoconsideran portavoces de los signos del universo tecnológico y los desarrollos de la tecnociencia, para inferir la propuesta ideológica del final del humanismo y el inicio de la era posthumanista. El trabajo concluye asignando a la Filosofía del Derecho la función de ser la conciencia de la IA que es Inteligencia sin conciencia; y de reivindicar la persistente necesidad de respetar y realizar los valores humanistas frente a su pretendida abolición por el posthumanismo. This paper presents Integrated Information Theory (IIT) 4.0. IIT aims to account for the properties of experience in physical (operational) terms. It identifies the essential properties of experience (axioms), infers the necessary and sufficient properties that its substrate must satisfy (postulates), and expresses them in mathematical terms. In principle, the postulates can be applied to any system of units in a state to determine whether it is conscious, to what degree, and in what way. IIT offers a parsimonious explanation of (...) empirical evidence, makes testable predictions, and permits inferences and extrapolations. IIT 4.0 incorporates several developments of the past ten years, including a more accurate translation of axioms into postulates and mathematical expressions, the introduction of a unique measure of intrinsic information that is consistent with the postulates, and an explicit assessment of causal relations. By fully unfolding a system's irreducible cause-effect power, the distinctions and relations specified by a substrate can account for the quality of experience. (shrink)

En primer lugar, se hace una aproximación a los términos de espacio, territorio, lugar y paisaje como categorías que permiten clasificar aquello que habitamos para, en segundo lugar, indagar en cómo habitamos estas categorías. We present a new metaphysical framework for physics that is conceptually clear, ontologically parsimonious, and empirically adequate. This framework relies on the notion of self-subsisting structure, that is, a set of fundamental physical elements whose individuation and behavior are described in purely relational terms, without any need for a background spacetime. Although the specification of the fundamental elements of the ontology depends on the particular physical domain considered---and is thus susceptible to scientific progress---, the empirically successful structural features of the (...) framework are preserved through theory change. The kinematics and dynamics of these self-subsisting structures are technically implemented using the theoretical framework of Pure Shape Dynamics, which provides a completely relational physical description of a system in terms of the intrinsic geometry of a suitably defined space called shape space.
